StealthInterview.ai ("we", "our", or "us") provides an AI-powered service for interview assistance through desktop app technology ("the Service"). By accessing or using our Service, including any desktop applications we provide, you agree to be bound by these Terms of Service.
2. Account Usage and Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Create an account and maintain accurate account information
- Keep your login credentials and license key secure
- Comply with any usage limitations specified in your subscription plan
- Not attempt to circumvent any service limitations
- Use the Service in compliance with all applicable laws and regulations
3. Privacy and Data Usage
Regarding your privacy and data:
- We do not store personal information captured during screen sharing sessions on our servers
- The desktop application processes screen captures locally
- Data transmitted to our servers for processing is used solely for providing the Service
- We implement industry-standard security measures to protect any data in transit
- We may collect anonymized usage metrics solely to improve our service
- You are responsible for ensuring you have necessary permissions for any information captured during screen sharing
4. Desktop Application Usage
Regarding the desktop application:
- We provide the desktop application "as is" without warranties of any kind
- We are not liable for any technical issues, system errors, or compatibility problems
- For technical support, you must use our designated support channels
- You are responsible for maintaining a compatible system environment
- You may not reverse engineer, decompile, or modify the desktop application
- You may not distribute or share your license key with others
5. User Responsibility and Ethical Use
You acknowledge and agree that:
- You are solely responsible for how you use this Service
- You will determine independently how to use this tool in accordance with your own ethical standards
- We reserve the right to terminate service to users who engage in fraudulent or illegal activities
6. Payment and Refunds
Regarding payments and refunds:
- All purchases are subject to our refund policy
- Payments are processed securely through our payment provider
- Subscriptions auto-renew unless cancelled before the renewal date
- We may change pricing with 30 days notice to active subscribers
- License keys are non-transferable and for single-user use only
7. Acceptable Use
You agree not to use the Service to:
- Access confidential or proprietary information without authorization
- Infringe upon intellectual property rights
- Generate content that promotes hate or discrimination
- Overwhelm or impair the Service or its infrastructure
- Attempt to gain unauthorized access to our systems or other users' accounts
8. Limitation of Liability
The Service is provided "as is" without warranties. We are not liable for:
- Accuracy or quality of AI-generated responses or content
- Any indirect, incidental, or consequential damages
- Service interruptions or technical failures
- Unauthorized account access
- Any system errors, crashes, or performance issues with the desktop application
- Any consequences resulting from your use of our Service during interviews or assessments
- Data loss or privacy issues resulting from your use of the Service
9. Intellectual Property
Regarding intellectual property:
- The Service, including all software and content, is owned by us or our licensors
- You retain ownership of your content but grant us a limited license to process it for the Service
- Our name, logo, and product names are our trademarks and may not be used without permission
- Feedback you provide may be used to improve our Service without compensation
10. Dispute Resolution
Any dispute arising from these Terms or the Service shall be resolved through binding arbitration, rather than in court. The arbitration shall be conducted in the State of Texas, and you agree to submit to the personal jurisdiction of the arbitrators located in Texas. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You agree that any legal action or proceeding between you and Stealth Interview shall be brought exclusively in the state or federal courts located in Texas.
12. Indemnification
You agree to indemnify, defend, and hold harmless Stealth Interview and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your use of the Service, violation of these Terms, or violation of any rights of a third party.
13. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease, but all provisions of these Terms which by their nature should survive termination shall survive.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Service after any revisions become effective constitutes your acceptance of the revised terms.
15. Refund Policy
We strive to ensure our desktop application works smoothly for all users. However, we understand that technical issues may occasionally arise due to unique system configurations. If you experience technical difficulties that prevent the proper functioning of our desktop application:
- Contact our support team promptly at support@stealthinterview.ai with a detailed description of the issue
- Provide video documentation demonstrating the technical issue in your specific environment
- Our technical team will work diligently to resolve the issue or provide workarounds
- For verified technical issues that cannot be resolved within a reasonable timeframe, we may offer, at our sole discretion, either a refund or complimentary subscription extension
- Each case will be evaluated individually based on the specific circumstances
- Refund requests for non-technical reasons or without supporting documentation may not be eligible
We value your satisfaction and will make good-faith efforts to address legitimate technical concerns. Please note that this policy applies only to verifiable technical issues with our desktop application and not to service dissatisfaction for other reasons.
